oth purchasers and vendors, of sites/facilities, are under increased pressure to ensure that the site or facility has not been contaminated and, that operations are in compliance with applicable regulations. Contamination can occur as a result of use by previous owners, spills or waste from adjacent properties.

ENVIRONMENTAL AUDIT

A Hotz Environmental Audit will help both parties avoid future legal liability and expensive site remediation costs. The Hotz team will conduct a complete audit program specifically designed to meet the needs of each client. The audit will ensure that the site/facility in question meets all Ministry of the Environment regulations.

An environmental audit involves a historical review of the previous uses of the site and a site/facility inspection to determine areas of potential risk or possible contamination. Where required, Hotz personnel will be responsible for the development and implementation of a remedial action plan with subsequent follow-up.

Complete documentation of each phase of the audit will be provided for the benefit of your lawyers, accountants, investors, and insurers.

SITE REMEDIATION

When a site/facility has been confirmed to be contaminated, the Ministry of Environment may issue a mandatory compliance order. The property owner must complete a site clean-up in compliance with Regulation 347 and the MOE decommissioning guidelines.

If an audit has been conducted, the Hotz team will review the results of the site history and the site inspection. A customized remediation plan will be developed and implemented in cooperation with the client. Once completed, Hotz Environmental Services will provide complete documentation of the procedures used and the method of recycling/disposal.

A site/facility that has undergone a clean-up in compliance with regulations and guidelines will enhance the insurability of the property and assets of the business.

SITE / FACILITY DECOMMISSIONING

When a site/facility is shut down, the Ontario Ministry of Environment requires that a decommissioning program be conducted. It should be noted that facility abandonment is not an acceptable alternative under any circumstances. Owners and operators who abandon facilities may be severely dealt with by the MOE.
